    I was putting together a lease, and wondering about late rent. Home is renting at $1000/m. I have a late rent charge of $25 after the 5th day. Due 1st, 5 day grace to 6th (for Friday Checks if needed), then on the 7th I add it. Let's say someone doesn't pay until the 20th, can you, or have you, added... show more
    I was putting together a lease, and wondering about late rent. Home is renting at $1000/m. I have a late rent charge of $25 after the 5th day. Due 1st, 5 day grace to 6th (for Friday Checks if needed), then on the 7th I add it. Let's say someone doesn't pay until the 20th, can you, or have you, added additional late charges? Is that a normal practice? Or is it just one late charge per rental invoice? Thanks

    Pipes do not burst because of ice: they burst because of pressure buildup between the freeze and valves in the house. Even if pipes freeze, opening the taps will release pressure and prevent a burst.

    Maybe you and your landlord can consult a licensed plumber and be reassured this is the case.

    Requiring you to keep the heat on high while the outside temperature is well-above freezing is unreasonable. A landlord cannot require this. You are responsible for damages if you are negligent, and burst pipes can be your responsibility if you are negligent. A few months ago someone posed a question here in which pipes burst when a tenant turned the heat off while leaving the rental for vacation! That would be a tenant's responsibility... but your landlord is being "paranoid,' if that's the right term. (In some cases, damages might be split according to respective responsibility; for example, the landlord could be held partly responsible if they failed to make precautions such as insulating pipes). There was a case in Detroit in which a pipe froze and the frozen water caused a floor collapse on tenants below; it is a serious issue.

    The laws dictating a tenant's responsibility are this: Wis. Stat. 704.07 Repairs; untenantability: 3.a and 3.b are the relevant statutes, regarding damage due to negligence of a tenant: Although not explicitly stated, maintaining a reasonable temperature in freezing weather to prevent pipes from freezing falls under these statutes (these are the statutes cited in several landlord-tenant cases in Wisconsin involving frozen pipes)

    3) Duty of tenant.

    (a) If the premises are damaged, including by an infestation of insects or other pests, due to the acts or inaction of the tenant, the landlord may elect to allow the tenant to remediate or repair the damage and restore the appearance of the premises by redecorating. However, the landlord may elect to undertake the remediation, repair, or redecoration, and in such case the tenant must reimburse the landlord for the reasonable cost thereof; the cost to the landlord is presumed reasonable unless proved otherwise by the tenant. Reasonable costs include any of the following:
    1. Materials provided or labor performed by the landlord.
    2. At a reasonable hourly rate, time the landlord spends doing any of the following:
    a. Purchasing or providing materials.
    b. Supervising an agent of the landlord.
    c. Hiring a 3rd-party contractor.
    (b) Except for residential premises subject to a local housing code, the tenant is also under a duty to keep plumbing, electrical wiring, machinery and equipment furnished with the premises in reasonable working order if repair can be made at cost which is minor in relation to the rent.
    (c) A tenant in a residential tenancy shall comply with a local housing code applicable to the premises.

Our lease states that "any tenants names herein or in the number of tenants occupying the leased premises must be pre-approved by the Lessor or Agent in writing and all new tenants must execute a new or revised lease agreement. Lessee shall not assign this lease or sublet premises without first obtaining the written approval of lessor or agent. Any unapproved assignment or sublease will be void. Our names are on the same lease.

    I work in a very small tense office, with 5 other women. One of the other women has been micromanaging, bossing me around, telling me what to do, I find her quite patronising. One day, I got really upset- my manager didn’t really do much, sent me on my way to the doctors, I got put on antidepressants and referred to occupational health and that was the end of it. Anyway, I get on well with another girl in the office and we are quite chatty about our feelings towards her. Whenever she walks out of the room, we talk about how tense we are feeling as her mood always changes or how snappy she is being.... a lot of the time it’s how the atmosphere is shocking. Yesterday, the girl over heard us? I said ‘have I done something wrong?’ And my colleague said ‘no, not at all... maybe she’s hormonal don’t take it personally’ and I said ‘well I feel like I have bexause yesterday when my doctors were calling me she was telling me to pick up the phone and I said I couldnt’ my colleague then said ‘well it’s ok for her to wait for a dog kennel... don’t worry about it’ She ran to management and HR quoting everything we have said, so we were pulled in for a meeting. I don’t think this is quite fair, I have raised my feelings before and got put on medication and management didn’t raise it further. But as soon as she runs, we get pulled in formally. I’d like opinions!

When someone does not file a tax return the IRS runs a substitute return using the worst case assumptions and if they think the person owes money they start collections and if they think the person is going to get a refund they just keep their money.

    The only way someone can be jailed for failure to file returns is if a court has specifically ordered them to file. In that case they could be arrested for contempt of court.

    Your Dad might be a bad man, but he (probably) won't go to jail just for not filing taxes.
