Is it illegal to sell a car with bad brakes? ?
My neighbor wants to sell his 2006 Honda accord but the brakes are bad and he dosen't have the money to fix them. I'm just wondering if that's illegal or can he just disclose it and sell it for a really cheap price

Not illegal. However, seller needs to be aware of local (state) laws that may still obligate them to pay for the repairs necessary to meet the inspection requirements, as is the case in Massachusetts (for one).

Yes he can sell it. But he should get a signed statement from the buyer stating he's aware of the brake problem.

He can disclose the bad brakes but that is a serious liability so it should be in writing and signed by the buyer. It should be very strongly worded, something to the effect of "The brakes on this vehicle are in need of repair and not safe in it's current condition. The seller strongly recommends having them repaired BEFORE driving it anywhere". That will probably scare any buyer away and not allow them to test drive the vehicle but it's that or having them repaired before selling it or sell it to a junk yard.

If he doesn't MISREPRESENT the brakes, there's nothing illegal.
If in ANY way he infers or states that the brakes are NOT defective, yes, it's illegal. He should see "as is" in any event.

If he discloses he knows they are bad, legal.

As long as he tells you the car has breaks or sells you the car is sold "as is" then it is totally legal. If the car is offered "as is" it would be up to you to have the car checked by a mechanic check out the car before you buy it.

Perfectly legal. He is selling it, not driving it. He just needs to disclose the problem or sell "as is".

He can sell it "as is" and disclose the issue, the brakes. He might want to do it in writing to document that he did make the disclosure in case something comes up later.

Those breaks are cheap. Sell it as is.
